Here’s a breakdown of what you can expect when you embark on the debt review process with us.
Our Step-by-Step Debt Review Journey
Navigating debt can feel overwhelming, but our structured process ensures clarity and support at every turn.
Your journey begins with a confidential assessment of your financial situation. Our certified Debt Counsellor will review your income, expenses, and existing debts to determine if you are over-indebted and if debt review is the most suitable solution for you. Once confirmed, you'll complete a simple application form.
After your application, we'll notify all your creditors and credit bureaus that you've applied for debt review. This crucial step immediately provides you with legal protection, stopping creditors from taking further legal action, harassing you with calls, or repossessing your assets while your application is processed.
Based on your affordability, our Debt Counsellor will draft a revised, affordable repayment plan for all your debts. We then formally propose this plan to your creditors, negotiating on your behalf for reduced interest rates and extended repayment terms to make your monthly installments manageable.
Once creditors accept the restructured payment plan, or if negotiations are necessary, we'll apply to the National Consumer Tribunal (NCT) or the Magistrate's Court to have your new payment plan made a binding court order. This legalizes your debt review process and protects you throughout your repayment journey.
With the court order in place, you'll make one single, affordable payment each month to a Payment Distribution Agency (PDA). The PDA then distributes these funds to your creditors according to the agreed-upon plan. This simplifies your payments and ensures all creditors receive their dues as per the court order.
Upon successfully paying off all your restructured debts (excluding a home loan or long-term assets, which continue under the original terms if applicable), our Debt Counsellor will issue a Clearance Certificate (Form 19). This certificate confirms you've fulfilled your obligations, and we'll then notify all credit bureaus to remove the debt review flag from your credit record, restoring your creditworthiness.
Details regarding the fees associated with the debt review process will be discussed transparently during your initial consultation. These fees are regulated by the National Credit Act and are designed to be affordable, ensuring that the process remains accessible and beneficial for you.
